KEADILAN SUBSTANTIF DALAM PELAYANAN KESEHATAN: INTEGRASI HUKUM DAN NILAI KEAGAMAAN

Healthcare is a fundamental right of every citizen, guaranteed by the constitution and laws and regulations.
However, practice still demonstrates a gap between legal norms and implementation, such as cases of repeated
referrals of BPJS patients and deactivation of membership, which hinder access to healthcare services. This
research uses a normative juridical method with a legislative, conceptual, and case study approach, integrating
religious values to examine the principles of justice, humanity, and moral responsibility in healthcare services.
The results show that despite strong legal guarantees, healthcare implementation still tends to be oriented
toward administrative procedures rather than the actual needs of patients. This condition reflects the failure to
achieve substantive justice, namely justice oriented toward tangible benefits and the protection of patient rights.
From a religious perspective, healthcare practices that neglect patient safety demonstrate a lack of
internalization of the values of justice, mercy, and moral responsibility. Therefore, integration of law and
religious values in healthcare delivery is necessary to create a more just, humane, and community-oriented
system.
